Anyone who has books from there might want to make sure they're backed up to your own hardware. There's a lot of unhappiness behind the scenes, apparently. Here. This isn't the first author I've seen who had complaints.

So, here’s where I ask for a favor…

Don’t buy my Ellora’s Cave books.

They still have the rights to my Icon Men trilogy – The First Real Thing,Appearing Nightly & A Fool for You. I want these books back. They’ve sold next to nothing over the past year, yet EC refuses to return them to me. So don’t buy them.

Very interesting.  EC ebooks have always been overpriced.  In the last couple of months, they've dramatically reduced the prices on a lot of their older stuff.  Some I know was just about to revert back to the author (Mari Carr just got the rights to like 16 of her EC books back).

Their newer stuff is still overpriced though.

I haven't bought anything from there in ages. Too much other stuff out there at better prices. I did make sure I had everything off the site, just in case it disappears.

I'm screwed. I went to go redownload everything I might have purchased there. I had a valid account, but SURPRISE! there is no content listed as having been purchased by me. Now, I ask you, who goes to a website and opens an account without actually purchasing anything? No one. If you're browsing, you don't open an account. Sneaky little sh*ts are now not letting people download previously purchased items and that's just wrong.

Wow. That really sucks, Nancy! 

I only went back to make sure I had no credit card information left there. I know I already downloaded everything as I purchased it, so didn't even check. 

It also could be that they gave back copyright to some author's already, so don't have the file anymore.

I'm not sure what backups there are if an author pulls their work. When Fictionwise hit the Agency War and the Big Named Publishers pulled out, there were several that I couldn't download again from those publishers. IIRC, Fictionwise had to work out some sort of deal so that those who'd already purchased them could have access for re-downloads.

Like Amazon, I'm not sure how many files the on-line publishers really hold on their site, and how many just have lists that point to the file on the publisher's server? I have no real clue.

EC changed and updated their website, hmmm, 4 or so years ago?  Nothing I'd purchased from the old site is available under my account on the new site.  Thanfully, I'm paranoid about keeping backups of my ebooks so I do have them all.

They wont get back the authors rights to books so that's NOT why the books are gone. They are trying to trick people into having to rebuy the books!

I can't name my writer friend who is owed around $3,000 from EC but she has asked for her rights back to all her books (around fifteen of them) and was told no.   Since all the authors signed contracts giving up those rights, they are up a creek without a paddle, legally.

Who do you mean, the publishes or the authors?

How would either one be trying to trick people into rebuying the ebooks? 

Since all the authors signed contracts giving up those rights, they are up a creek without a paddle, legally.

I'm not sure all the authors have the same contract. Some mentioned having the right to buy back their rights if sales go below a certain level for a specified amount of time. Unless that's another publisher I'm thinking of.

But, usually, I agree with you. Even if EC goes bankrupt, the copyrights belong to the company and will go to be sold to another publisher to pay EC's bills. They're company assets.

I know some authors are getting their stuff back.  Mari Carr just got back like 16 books in the last month, all were EC titles.

Cindy- EC is trying to trick people into rebuying the same ebooks by not showing them on their 'purchased' page.  They are trying to make more money.

Sadly lots of NEW authors who were attracted to EC did sign away their works, it was the more educated authors who were able to haggle and get better contracts.  OR if the owner liked you, the contract was better.   The more pull/fanbase the author has, the more likely they will get their stuff back.  BUT some authors aren't willing to go against EC and risk loosing it all.  (which is dumb as they are going to anyway at this rate.)

So let me ask this question: if you buy an EC book from a third party vendor, say

Tristan's Temptation by Sabrina York (new copies on sale in ebook and print at Amazon), does the author get paid? Or does that royalty money still cycle thru EC before getting to the author?

That I'd never heard. Not that I'd disbelieve it. 

On mine, my order history says I bought 33 items, and I have 33 in my bookshelf. So mine is fine that way.

It doesn't matter who sells it, it matters who owns the copyright.

If EC owns the copyright, they can arrange to sell the book through all kinds of other sellers. The sellers, who have to have permission to sell the book, then sends the agreed upon percentage of the sale back to EC.

Then it's up to EC to pay the authors.

It's the same as buying an actual book.    If you go to B&N, you buy a book, B&N pays the publisher, the publisher then pays the agent who then pays the author. (or the publisher pays the author if its a small press with no agent needed).

Ed. I'm not advocating taking her up on the offer, but just that this is what is happening.

Seriously, I wouldn't want this to come back and bite her in the butt. EC may or may not sue her over this. (I do agree that they probably won't, as that could mean someone getting a look at their books.) But I feel for the author, and wouldn't want to add to a problem if this comes back to haunt her.

Ellora's Cave sues Dear Author. Here.

Since EC has sued someone before, then not shown up for court, people are going to be watching this for three reasons. 1) To see if she or her rep. show up in court, 2) if EC drops the case because she'll have to let people see her records is she goes ahead, and 3) If EC does go to court, what those records say.

Since many authors and ex-workers of EC have come out public, saying they haven't gotten paid for a while, I have a feeling EC isn't going to come out ahead in this, no matter what they do.

What a dumb move on EC's part, I'm sure it'll be dropped before it goes to discovery because EC doesn't want to open its records.  Too many authors are coming forward saying they're not being paid.

I see there's now a GoFundMe set up to help fight the court case.  Even if it's thrown out, the owner of Dear Author still has to pay legal fees.

It's crazy, but there's hope that this case will force EC to open their books. 

There's a lot of authors who have questions about their bookkeeping, and where all the money has been going. Especially since the EC owner, got rid of some employees and contracted workers, missed paying royalties for quite a while, (still missing having paid some IIRC) and is supposed to be starting up some new publishing projects.

They question that if she can't pay authors, editors and cover designers what they're owed, then how does she have money to start up a new publishing project? That, and that apparently on her Facebook page she's bragging about all the money she's been spending.

The more I read online about what's she's doing the more I shake my head.  Definitely narcissist traits.  Not sure if she officially violated the gag order on the motion for a TRO but good heavens, shut up already I say!  What's that saying better to be thought of as an idiot then to open your mouth and prove them right?
