This fourth edition has been thoroughly updated to cover the important new developments in Transfer of Undertakings, looking specifically at the key case in this area, Oy Liikenne ab v Liskojarvi and another 25.1.01 Case C-172/99 [2001] IRLR 171, European Court of Justice. The book also charts the progress of the implementation by the UK of the revised Acquired Rights Directive 1998. On Equal Pay, the key cases of R v Secretary of State for Employment ex parte Seymour + Smith + Perez (No 2) [2000] IRLR 263 and Janstalldhetsombudsmannen v Orebro Lans Landsting Brunhoffer v Bank der Osterreichishen Postsparkasse [2001] are highlighted and discussed. The new Employment Bill 2001 is also included. On Sex Race and Disability Discrimination, the Race Discrimination Directive, Human Rights Act 1998, Sex Discrimination (Indirect Discrimination and Burden of Proof) Regulations 2001, Part-time Workers (Prevention of Less Favourable Treatment) Regulation 2000, Race Relations (Amendment) Act 2000 and the Creation of Disability Rights Commission Act 1999 are all now included. The book will also trace the progress on implementing the EU directive on fixed term work by the draft Fixed-Term Employees (Prevention of Less Favourable Treatment) Regulations. New cases in the collection on this area now include Badeck & Others [2000] and Abrahamsson & Anderson v Fogelquist [2000] - both on positive action, and Pearce v Governing Body of Mayfield Secondary School [2001] on homophobic abuse, as well as Jones v Post Office [2001] - on disability. On Health and Safety the two most important judgements relating to the scope of an employer's vicarious liability - Lister v Helsey Hall Ltd [2001] IRLR472, HL and Fenelly v Connex South Eastern Ltd [2001] IRLR 390, CA are both dealt with in helpful detail.
