The heavily revised Third Edition presents new material on student welfare issues, the rights of conscience on the part of student athletes, and youth sports. An expanded discussion on the relationship between athletes and their institutions explores Boise State, USC, and Ohio State NCAA infractions cases; NCAA academic reforms measures; and relevant cases such as Giuliani v. Duke University. The new Court of Arbitration for Sport awards and the interpretation of the World Anti-doping Code (including USOC v. IOC and WADA v. BOC) are introduced. An updated summary of coaches contracts considers Leach v. Texas Tech in the termination of coaches contracts, developing law on misrepresentations in coaches resumes, and the constitutional rights of coaches. Sports and labor law issues reviewed include antitrust and labor law; NFL and NBA labor disputes and Brady v NFL litigation; and the use of performance-enhancing drugs and the efficacy of current regulations. Landmark court decisions inform the Third Edition: American Needle v. NFL rejecting the single entity defense; In re Phoenix Coyotes (antitrust and bankruptcy law); and cases dealing with First Amendment rights and intellectual property or contract rights (Hart .v Electronic Arts, Inc., Keller v. Electronic Arts, Inc., Brown v. Electronic Arts, Inc., and Wisconsin Interscholastic Athletic Ass n v. Gannett Co., Inc.) Recent developments regarding sports agents are discussed, from player association regulations to the criminalization of agent misconduct to ethics opinions regarding lawyers serving as sports agents. The Third Edition introduces new material on the impact of race and shifting demographics in American sport, political and policy developments in gender equity, and sexual identity issues. The current focus on health, safety, and risk management in sports is highlighted through the principal case Shin v. Ahn (co-participant liability) along with an exploration current concerns and controversies: the connection between sports-related head trauma and life-altering brain damage; heat-impacted sports injuries and deaths; the threat of intense aerobic activity for athletes with the trait for sickle cell disease ; the proper venue within which athletes can seek workers compensation benefits; the impact of the American with Disabilities Act on athletes performance opportunities; the enforceability of liability waivers; sovereign immunity issues.
