Ejectment is the action by which a person having a right of entry into land recovers possession. juhn Doe The proceedings have been commenced hitherto Richard Roe 7 e delivery, to the person in possession, of a -- declaration in an action of trespass and ejectment, alleged to have been commenced at the suit of a fictitious person, generally called John Doe (" the nominal plaintiff"), against another fictitious person, generally called Richard Eoe (" the casual ejector.") This declaration stated that the person, in whom the title really was (" the lessor of the plaintiff"), had, on a day named, made a lease to John Doe, of the property sought to be recovered, that property being described so vaguely as to give no clue whatever to its identity. John Doe was then stated to have entered, and remained in possession until Richard Roe had ousted or ejected him ; and it was then alleged, that John Doe had sustained damage by such ejectment. After this statement, came a letter from Richard Roe, addressed to the person in possession, advising him to appear in court, and be made defendant in the stead of him, ...« less
