He has 70 episodes of the show under his belt from 2005-2009, and has been nominated for six primetime Emmy Awards. The duo are also members of a band called The Solids. Prior to the creation of How I Met Your Mother, Bays and Thomas wrote for a number of television shows including Oliver Beene and Quintuplets. They also wrote part two of the American Dad! episode "Stan of Arabia".

According to a National Public Radio article about censorship and sitcoms, Bays' mother is an ordained minister and regularly gives him feedback on How I Met Your Mother. Regarding his mother, Bays said, "She'll never call me on something being too dirty or too explicit. She'll call me on something not being funny. That's much more embarrassing." Bays is a graduate of Wesleyan University, and of Shaker Heights High School.
